Golden Visa

The Portugal Golden Visa scheme, introduced in 2012, is a 5-year programme which was designed to encourage investment from non-EU nationals by providing attractive tax benefits to investors. Also known as the Golden Residency Permit Programme, it is essentially a fast track to obtaining full residency in Portugal without the requirement to reside in the country for extended periods of time.

To acquire the Golden Visa, applicants are required to make a financial investment in real estate or business and retain the investment for a period of 5 years. Additionally, the holder must spend a minimum of 7 days in Portugal during the first year, and 14 days in every subsequent 2-year period. Applicants must be nationals of non-EU, non-Swiss or non-EEA countries and have a clean criminal record.

The Golden Visa allows investors and their families to work, live and study in Portugal and to travel freely within the EU and the countries of the Schengen area. Family members include spouse/partner, dependent children, parents over 66 years of age (or 55 if dependent) and siblings under the age of 18. Holders and their families also have the right to health care, education and the justice system.

Listed below are the real estate investment options for obtaining a Golden Visa:

  • Purchase of a residential property, or properties, with a minimum total value of €500,000 in specified interior areas of Portugal (eg, excludes Lisbon, Porto or the coastal towns of the Algarve and Silver Coast). A discount of 20% is applied if the property is located in a low-density area (ie, fewer than 100 inhabitants per square kilometre, or a per-capita GDP of less than 75% of the national average). For a property over 30 years old, or a rehabilitation project in an urban renewal area, the minimum investment required is €350,000.
  • Purchase of a commercial property - the amount of investment is as above but can be located anywhere in Portugal.
  • Purchase of a residential or commercial property, with a minimum value of €500,000, anywhere in Madeira or the Azores. For a rehabilitation project, the minimum investment is €350,000.

Buying property in Portugal has become an extremely popular scheme for obtaining residency through investment. The sunny climate, glorious unspoilt beaches, delicious cuisine and quality of life attract many property investors, whether it be for retirement, a holiday home or for rental income. Tourism is thriving, especially in the Algarve; rental properties are in demand and yields are high.

Alternative Golden Visa investment options are:

  • subscription of at least €500,000 to a qualifying investment fund
  • capital transfer of €1,500,000 minimum
  • contribution of €500,000 minimum to scientific or technological research
  • establishment of a company, creating 10 jobs equating to a minimum of €500,000
  • investment of €500,000 minimum into a registered business in Portugal
  • donation of €250,000 minimum in support of national heritage reconstruction or the arts.

To apply for the Golden Visa an investment must be made prior to submitting the application. Once the visa has been issued, it is then valid for 2 years and will need to be renewed at the end of each subsequent 2-year period. At each renewal, visa holders will need to provide biometric data and updated original documents. After 5 years have elapsed, holders are able to apply for permanent residency and citizenship, subject to certain qualifying conditions being met including passing a basic Portuguese language test.

Golden visa benefits include:

  • freedom to travel within the countries of the EU and Schengen area
  • freedom to live, work and study in Portugal
  • a very low stay requirement
  • attractive tax rates/concessions by registering as a non-habitual resident (NHR)
  • residency entitlement for family members
  • access to the national health care system
  • access to the justice system
  • permanent residency and/or citizenship after 5 years.
